Terms of Service
1. Scope of Services 1.1. BERGSTROM PAINTING offers painting services as agreed upon with the client. 1.2. Services include but are not limited to interior and exterior painting, surface preparation, minor repairs, and consultation on paint selection.
2. Estimates 2.1. All estimates provided by BERGSTROM PAINTING are based on the information provided by the client and on-site evaluation. 2.2. Estimates provided are valid for 30 days unless otherwise stated in writing by BERGSTROM PAINTING. 2.3. Upon the signature of the painting agreement, it constitutes a binding contract between the client and BERGSTROM PAINTING. 2.4. A 25% material deposit is required for booking services with BERGSTROM PAINTING. 2.5. The Client is expected to pay the full balance due upon completion of the project.
3. Payment Terms 3.1. Clients agree to pay the agreed-upon amount for services rendered by BERGSTROM PAINTING. 3.2. A material deposit of 25% is required before the commencement of work, with the remaining balance due upon completion. 3.3. Payment methods accepted include debit, credit, cash, and Electronic Funds Transfer (EFT) for commercial clients. 3.4. For commercial clients, BERGSTROM PAINTING requires vendor authorization if payments are to be processed through a vendor or third party. The responsibility lies with the client to provide necessary authorization and ensure timely payment release. 3.5. Any additional services requested by the client, not included in the initial agreement, will incur extra charges.
4. Cancellation and Rescheduling 4.1. Clients are required to provide at least [3] three days' notice for any cancellation or rescheduling of services. 4.2. BERGSTROM PAINTING reserves the right to charge a rescheduling fee if proper notice is not provided by the client. 4.3. BERGSTROM PAINTING reserves the right keep the material deposit on file in the case of project cancellation.
5. Liability and Damages 5.1. BERGSTROM PAINTING carries $3 million in liability insurance and is registered with the Workplace Safety and Insurance Board (WSIB). 5.2. The Company will take reasonable care during the provision of services, but it shall not be liable for damages resulting from factors beyond its control, including but not limited to existing structural issues or unforeseen circumstances. 5.3. Clients are responsible for ensuring the area to be painted is clear of valuables and personal belongings. If any items cannot be removed, including furniture, they will be appropriately covered and protected by BERGSTROM PANTING. BERGSTROM PAINTING will not be liable for damage to items not removed as agreed between BERGSTROM PAINTING and the customer.
6. Completion Timeframe 6.1. The estimated completion timeframe provided by BERGSTROM PAINTING is an approximation and may be affected by various factors, including weather conditions and unforeseen challenges.
7. Warranty 7.1. BERGSTROM PAINTING provides a one-year warranty on vertical surfaces for workmanship. 7.2. This warranty covers defects in workmanship but does not include normal wear and tear or damage caused by improper use or maintenance.
8. Termination 8.1. Either party may terminate the contract by providing written notice in case of a material breach of this agreement by the other party.
9. Governing Law 9.1. This agreement shall be governed by and construed in accordance with the laws of Ontario, Canada.
By engaging with BERGSTROM PAINTING's services, clients acknowledge that they have read, understood, and agreed to these terms and conditions.
